Terms of Service

These Terms of Service and Rental Agreement (“Terms”) govern rentals from PrimePlay Rentals (“PrimePlay Rentals,” “we,” “us,” or “our”). By submitting a rental request and checking the agreement box, and again by accepting possession of the rented equipment, the renter (“Renter,” “you,” or “your”) acknowledges that they have read, understood, and agree to these Terms.

1. Eligibility and Rental Requests

You must be at least 18 years old and legally capable of entering into a contract to rent equipment. Submission of a rental request does not guarantee a reservation. All rentals, equipment, games, accessories, dates, and times are subject to availability and confirmation by PrimePlay Rentals. We may decline or cancel a rental request before equipment is delivered where inventory is unavailable, information cannot be verified, or the requirements of these Terms are not satisfied.

2. Renter Identification and Verification

The person named on the rental request must personally attend pickup. The Renter must present a valid, unexpired government-issued photo identification document at pickup. The name on the identification must match the full legal name submitted with the rental request. PrimePlay Rentals may refuse to release equipment if identity cannot reasonably be verified or the information does not match. Equipment will not be released to a substitute person.

3. Rental Period, Pickup and Return

The rental period is the period confirmed by PrimePlay Rentals. Pickup and return take place at Atrium on Bay, 595 Bay St., Toronto, Ontario M5G 2C2, downstairs near the CIBC bank. The regular pickup and return window is 6:00 PM to 7:00 PM daily, in 15-minute increments. The Renter must return all equipment by the confirmed return date and time unless PrimePlay Rentals agrees to a change in writing.

4. Rental Charges and Security Deposit

The Renter must pay the confirmed rental charge and a $200 refundable security deposit in cash at pickup before equipment is released. The security deposit is security for the Renter's obligations and is not a limit on the Renter's liability. Subject to inspection, the unused balance of the deposit will be returned after all rented equipment and accessories have been returned on time and in substantially the same condition as provided, ordinary wear and tear excepted.

PrimePlay Rentals may apply all or part of the deposit toward unpaid rental charges, missing items, damage beyond ordinary wear and tear, or other amounts properly owing under this Agreement. If an amount is deducted, PrimePlay Rentals will identify the reason and amount. If the Renter's liability exceeds the deposit, the Renter remains responsible for the balance.

5. Equipment Care and Responsibility

From the time equipment is handed to the Renter until it is returned and accepted by PrimePlay Rentals, the Renter is responsible for its reasonable care, custody, and control. The Renter agrees to keep the equipment secure, dry, clean, adequately ventilated, and protected from theft, impact, liquids, smoke, excessive heat, pets, misuse, and other avoidable hazards; to use it only for its intended purpose and in accordance with manufacturer instructions; and not to open, disassemble, modify, repair, sell, pledge, transfer, or otherwise dispose of it.

The Renter must not lend, sub-rent, or transfer possession of the equipment to another person. The Renter must promptly notify PrimePlay Rentals of loss, theft, malfunction, or damage and must not attempt repairs without written authorization.

6. Condition, Damage, Loss and Replacement Cost

The Renter should inspect the equipment at pickup and promptly identify any visible pre-existing damage or missing item. PrimePlay Rentals may document the equipment's condition and included items at pickup and return.

The Renter is financially responsible for loss, theft, destruction, missing equipment or accessories, and physical damage occurring during the rental period, except to the extent caused by ordinary wear and tear or by a defect or condition for which applicable law makes PrimePlay Rentals responsible. Where an item is lost, stolen, destroyed, not returned, or damaged beyond economically reasonable repair, the Renter is responsible for the reasonable full replacement cost of an equivalent item of the same or reasonably comparable model, age, condition, and functionality, plus applicable taxes and reasonable directly related replacement costs. Where repair is economically reasonable, liability will ordinarily be limited to the reasonable repair cost and directly related costs. PrimePlay Rentals will not charge both full replacement cost and repair cost for the same loss.

7. Late or Incomplete Returns

All equipment, controllers, games, cables, and other supplied accessories must be returned by the confirmed date and time. If equipment is returned late, PrimePlay Rentals may charge additional rental fees at the applicable daily rental rate for the period reasonably attributable to the late return, subject to applicable law. Missing components may be treated as unreturned items and charged at their reasonable replacement cost.

8. Games, Accounts and Data

Physical game rental is optional. A Renter who has their own PlayStation account may sign in on the rented console and access compatible digital games and content available through that account, subject to Sony/PlayStation licensing, account, subscription, network, and compatibility requirements. PrimePlay Rentals does not guarantee that any particular digital title, entitlement, subscription benefit, saved data, or online service will be available.

The Renter is responsible for safeguarding their own account credentials and personal data. The Renter should sign out of personal accounts and remove their account and personal information from the console before return. PrimePlay Rentals is not responsible for loss of game progress, locally stored data, account access, or other digital information except to the extent liability cannot lawfully be excluded.

9. Proper and Lawful Use

The equipment may be used only for lawful personal entertainment purposes. The Renter must not use the equipment in connection with unlawful activity, circumvention of security protections, unauthorized modification, or conduct that violates applicable platform or software terms.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PrimePlay Rentals is not liable for indirect, incidental, special, consequential, or purely economic losses arising from the Renter's use or inability to use the equipment. Nothing in these Terms excludes, restricts, or waives any right, warranty, remedy, or liability that cannot lawfully be excluded or restricted under applicable Ontario or Canadian law.

11. Indemnification

To the extent permitted by law, the Renter agrees to indemnify and hold harmless PrimePlay Rentals and its owner, personnel, and agents from third-party claims, losses, liabilities, damages, and reasonable costs arising from the Renter's unlawful use, misuse, unauthorized transfer, or negligent or intentional damage to the rented equipment, or the Renter's breach of these Terms. This provision does not require the Renter to indemnify PrimePlay Rentals for PrimePlay Rentals' own negligence, wilful misconduct, breach of law, or any liability that cannot lawfully be excluded.

12. Consumer Rights

These Terms are intended to operate together with applicable consumer-protection and other mandatory laws. If applicable law gives the Renter a right or remedy that cannot be waived, these Terms do not waive or restrict that right or remedy.

13. Electronic Agreement and Records

The Renter agrees that checking the Terms acceptance checkbox and submitting the rental request constitutes electronic acceptance of these Terms. PrimePlay Rentals may retain the rental request, acceptance record, confirmation communications, and transaction records as evidence of the agreement. A copy of these Terms should be saved or printed by the Renter for their records.

14. Governing Law and Jurisdiction

These Terms and each rental are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Subject to any mandatory consumer right to bring a proceeding elsewhere, the parties attorn to the courts of Ontario for disputes arising from the rental or these Terms.

15. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, it will be severed or limited to the minimum extent necessary, and the remaining provisions will continue in effect. These Terms, together with the confirmed rental details and any written amendments agreed by the parties, constitute the agreement governing the rental. No amendment is effective unless agreed to by the parties in writing or electronically.
